§ 1 Scope
These GTC regulate:
1. The use of the mobile application “DiGOR – Digital Gold Rush”
2. Digital content and in-app purchases
3. Crowdfunding support via

o Third-party platforms such as Kickstarter
4. The use and representation of the DiGOR ecosystem at
o https://ecosystem.digor.gold
These GTC apply to consumers and entrepreneurs.
The use of the app is allowed for persons aged 13 and over.
For users under 18, the consent of the legal guardians is required.
§ 2 Contract Partner
The contract partner is:

The app is provided through third-party platforms such as the Apple App Store and Google Play.
For purchases and subscriptions through these platforms, only the respective platform provider is the contract partner.
For crowdfunding through funding.digor.gold, IQ WORLD GAMES AG is the direct contract partner.
For campaigns via Kickstarter, their platform conditions additionally apply.
§ 3 Updates and Functionality
IQ WORLD GAMES AG provides security-relevant and legally required updates.
Functions may be changed, expanded, or discontinued at any time.
There is no entitlement to the permanent availability of specific features or content.
§ 4 Data Protection
The processing of personal data occurs in accordance with:
· Swiss Data Protection Act (DSG)
· EU General Data Protection Regulation (GDPR), as applicable

§ 5 In-App Purchases and Subscriptions
Digital content and subscriptions can be purchased within the app.
Subscriptions renew automatically unless they are canceled in a timely manner.
Billing is done through the respective app store.
Price changes are reserved.
§ 6 Crowdfunding & Digital Support Models
IQ WORLD GAMES AG offers reward-based crowdfunding.
Supporters acquire:
· no shares
· no participations
· no tokens
· no financial instruments
· no profit participation
· no voting rights
The support serves exclusively to finance the further development of the game.
It is not an investment or a capital investment.
§ 7 Digital Rewards
As part of the crowdfunding, only digital content is offered, in particular:
· In-game items
· digital advantages
· early access
· virtual content
Delivery is based on:
· successful funding
· technical implementation
· progress of the development project
There is no entitlement to immediate delivery.
§ 8 Development Character of the Project
DiGOR is an ongoing development project.
It may be subject to:
· delays
· functional changes
· design adjustments
· technical modifications
may occur.
Supporters explicitly recognize this development character.
§ 9 Right of Withdrawal for Digital Content
For consumers residing in the European Union:
The right of withdrawal expires for digital content as soon as:
· the user explicitly agrees to the commencement of execution,
· and confirms that he loses his right of withdrawal.
For supporters residing in Switzerland, there is no statutory right of withdrawal, unless granted voluntarily.
For Kickstarter, their refund regulations additionally apply.
§ 10 Liability
IQ WORLD GAMES AG is only liable in the case of:
· intent
· gross negligence
· injury to life, body, or health
Liability for:
· project delays
· functional changes
· economic expectations
· dissatisfaction
· indirect damages
is excluded, as far as legally permissible.
The app is intended solely for entertainment purposes.
§ 11 Usage Rights
The user receives a simple, non-transferable, non-sublicensable right of use.
Reverse engineering, duplication, distribution, or commercial use is prohibited.
All rights remain with IQ WORLD GAMES AG.
§ 12 Code of Conduct
Particularly prohibited are:
· illegal use
· manipulation of the game
· use of bots or cheats
· offensive, discriminatory, or illegal content
In case of violation, access may be permanently blocked.
§ 13 DiGOR Ecosystem
The website https://ecosystem.digor.gold serves to present the conceptual and strategic framework of the DiGOR project.
The content described there does not constitute binding performance promises.
In particular, the representation of the ecosystem:
· does not establish a claim to the implementation of individual modules
· does not provide for economic participation
· does not create expectations of profit
· does not present an investment opportunity
· does not establish a claim to real assets
The ecosystem may be adjusted, expanded, reduced, or restructured at any time.
§ 14 Export Control & Sanction Law
The app may not be used, exported, or transferred to countries subject to sanctions or embargoes.
Users are required to comply with all applicable export control regulations.
§ 15 Applicable Law
The substantive law of Switzerland applies.
Mandatory consumer protection provisions of the EU remain unaffected.
The place of jurisdiction is Zug, Switzerland, as far as legally permissible.
§ 16 Severability Clause
Should individual provisions of these GTC be ineffective, the effectiveness of the remaining provisions shall remain unaffected.
