General Terms and Conditions (GTC)

These General Terms and Conditions (GTC) govern the use of the mobile applications of IQ WORLDGAMES AG. They are part of any use and are binding upon downloading, installing, or using the app, even without explicit consent through clicking or registration.

Please read these terms carefully before using the app. By using the app, you confirm that you understand these GTC and agree to them.

§ 1 Scope

This app is exclusively intended for adults (18 years and older). Use by minors is prohibited.
These General Terms and Conditions (“GTC”) apply to the use of the mobile applications (“apps”) of IQ WORLDGAMES AG as well as to all future versions, extensions, and similar mobile applications. They apply to consumers and entrepreneurs unless explicitly stated otherwise.

 

§ 2 App Store and Contract Partners

The provision of the apps is made via third-party platforms such as the Apple App Store or Google Play. The contractual partner for purchases and subscriptions is solely the respective platform provider. IQ assumes no liability for payment transactions, refunds, or technical disturbances on these platforms.


§ 3 Updates and Functionalities

IQ provides security-related and legally required updates. Functions can be changed, expanded, or discontinued at any time. Users have no claim to receive specific functions, even if they were previously advertised, provided, or used. Changes to functions occur at the discretion of IQ WORLDGAMES AG to protect technical, economic, or legal interests.


§ 4 Data Protection and Access Permissions

Access to the camera, location, or other device functions is granted only with the explicit consent of the users in accordance with Swiss data protection law (DSG) and the EU General Data Protection Regulation (GDPR), where applicable. § 5 In-App Purchases and Subscriptions

Digital content and subscriptions can be purchased within the app. Subscriptions automatically renew unless terminated in a timely manner. Billing is done through the respective app store. Price changes are reserved; users will be informed in good time.


§ 6 Right of Withdrawal and Refunds

Withdrawal and refunds are to be processed exclusively through the respective app store. IQ is not responsible for this. Legal consumer rights remain unaffected.

 

§ 7 Liability

IQ WORLDGAMES AG provides the mobile application free of charge and “as seen.” The app is intended solely for private entertainment and contains no safety-relevant, medical, or pedagogically tested content.

Liability of IQ WORLDGAMES AG – regardless of the legal basis – is excluded unless mandatory legal provisions oppose this. In particular, IQ assumes no liability for damages arising from the use or unavailability of the app, including indirect damages, data loss, lost profits, system failures, or compatibility issues.

This liability exclusion does not apply in cases of intent or gross negligence or in the event of injury to life, body, or health caused by IQ WORLDGAMES AG.

Users are responsible for the backup of their own data and device settings.


§ 8 Usage Rights

IQ grants users a simple, non-exclusive, non-transferable, and non-sublicensable right to use the app. Reverse engineering, editing, reproduction, distribution, and any further use of the app or its components are prohibited unless expressly permitted by mandatory law, particularly to achieve interoperability pursuant to Article 5 of EU Directive 2009/24/EC.

All content, graphics, software components, and databases of the app are protected by copyright. Any unauthorized reproduction, distribution, or publication – in particular within the framework of piracy, cracked versions, or in torrent sites – is prohibited and pursued both civilly and criminally.

IQ WORLDGAMES AG expressly reserves all rights to the app and its content, including any trademark, design, and patent rights.


§ 9 Jurisdiction and Applicable Law

Swiss material law applies. The place of jurisdiction is Zug, Switzerland, unless the user is an entrepreneur or a legal entity. The UN Sales Convention is excluded.

 

 § 10 Severability Clause

If individual provisions of these GTC are wholly or partially ineffective, the effectiveness of the remaining provisions remains unaffected. Instead of the ineffective clause, a regulation comes into effect that comes closest to the economic purpose.

Consumers residing in the European Union have the right to submit complaints to the competent data protection supervisory authority. For Germany, this is the Federal Commissioner for Data Protection and Freedom of Information (BfDI), for other EU countries the respective national supervisory authority.

For out-of-court dispute resolution, the EU platform for online dispute resolution (ODR platform) can be used: https://ec.europa.eu/consumers/odr. IQ WORLDGAMES AG is currently not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.


§ 12 Rules of Conduct, Age Rating, and Prohibited Use

The use of the app for illegal, offensive, discriminatory, or violent purposes is prohibited. In case of violation, access can be permanently blocked; legal action remains reserved.

The use of the app is only permitted for adults (18 years and older). Use by minors is prohibited and may result in permanent blocking and legal action. The provider reserves the right to request identification evidence in case of doubts about the age statement. Parents or legal representatives are liable for all actions of minors who access the app in violation of these GTC. IQ WORLDGAMES AG excludes all liability for damages or obligations arising from the unauthorized use by minors. The Youth Protection Act (JuSchG) applies to users from Germany; content that is age-restricted may only be used by appropriately aged individuals.

 

 § 13 Export Control & Sanctions Law

The app may not be used, exported, or transferred in countries that are subject to sanctions, embargoes, or export restrictions. Users are obliged to comply with all applicable national and international export control, customs, and sanctions regulations, including EU regulations, US Export Administration Regulations (EAR), and comparable regulations.
